Website terms
The plain-English terms for every website we build and every monthly plan. If anything here is unclear, email breakthroughbytes@gmail.com and ask.
These terms apply to every website Pagefive builds and every monthly plan. "We" and "Pagefive" mean Dale Purvis trading as Pagefive. "You" means the business that orders the website. Your order confirmation email sets out what you have ordered; these terms cover everything else.
What we build
- We build the website described in your order confirmation: the build tier, the number of pages, and any extras listed there.
- We write the first draft of the words from what you tell us and what is public about your business. You check it and correct anything that is wrong before it goes live.
- Each build includes the rounds of changes before launch shown for its tier: Starter one round, Business two rounds, Premium three rounds. A round is one list of changes sent together. More rounds, or work outside the order, are charged at £20 an hour, and we tell you the likely cost first.
- Anything not in the order confirmation is not included. Common examples: photography, logo design (except the Premium brand kit), paid advertising, and copy for regulated claims that needs a professional's sign-off.
Timing
- The delivery time in your order starts when we have your deposit and the items on the onboarding checklist.
- If we are waiting on something from you for more than 14 days, the project pauses. If it stays paused for 60 days, we may close it and keep the deposit.
Payment
- Builds are paid 50% before we start and 50% when you approve the site and it goes live. Invoices are due within 7 days.
- Monthly plans are paid in advance each month by standing order or card, starting on the day the site goes live.
- If a payment is more than 14 days late we may pause the site or the plan until it is paid.
- Prices are in pounds. Any VAT is shown on your order confirmation and invoice.
Cancelling
- You can cancel a build at any time by email. The deposit covers work already done and is not refunded once we have started the draft. If you cancel before we start, we refund it in full.
- Monthly plans have no minimum term. Cancel by email with 30 days' notice and the plan ends at the end of that period.
Who owns what
- Once the build is paid in full, the website content and design made for you belong to you. Until then, we keep ownership and may take the site offline if the balance is not paid.
- Your domain is registered in your name and is yours. Where we register it for you, we transfer control to you on request at any time.
- We keep ownership of our underlying code, templates and tools, and you get a permanent licence to use them as part of your site.
- You can ask for a copy of your site's files at any time after full payment, and take them to another host.
- We may show your site in our portfolio unless you ask us not to.
Hosting and the first year
- Every build includes 12 months of hosting from launch. After that, hosting is included in any monthly plan, or costs £5 a month on its own. If you choose neither, we give you the site files and switch hosting off after 30 days' notice.
- We aim to keep the site online at all times but cannot guarantee it. Our hosting provider's outages are outside our control.
Your content and your responsibilities
- You confirm you have the right to use everything you send us: logos, photos, text and product details.
- You are responsible for what your website says about your services, prices and results. Regulated sectors have advertising rules: for example, prescription-only medicines (including some injectable treatments) cannot be advertised to the public in the UK. We will point out claims we think are a problem, but the final say and responsibility are yours.
- If the site collects personal data (enquiry forms, bookings), you are the data controller. We set up the form and a basic privacy notice; you are responsible for how you use the data.
Search and results
- We build every site so Google can read it, and the Grow and Lead plans include ongoing local search work. Nobody controls Google's rankings, so we do not guarantee positions, traffic, calls or sales.
Liability
- Our total liability to you for anything connected with these terms is limited to the amount you have paid us in the 12 months before the claim.
- We are not liable for lost profits, lost business or indirect losses.
- Nothing in these terms limits liability that cannot be limited by law.
General
- These terms, with your order confirmation, are the whole agreement. If they conflict, the order confirmation wins.
- We may update these terms for future orders. Changes do not affect an order already agreed.
- These terms are governed by the law of England and Wales.
